Transboundary movement of waste

Waste cannot be imported, exported or moved in transit through Ukraine without permit documents from the Ministry of Environmental Protection. We determine which list the waste belongs to and arrange a conclusion or written consent. The service is for companies and sole proprietors across Ukraine — Kyiv, Odesa, Kharkiv, Dnipro.

The Basel Convention and regulation

Transboundary movement of waste is regulated by the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, to which Ukraine has been a party since 1999. The national rules and the Green and Yellow lists themselves are approved by a Cabinet of Ministers resolution.

Green and Yellow lists

Green list: Ministry of Environment conclusion

The Green list is waste that does not contain hazardous substances and moves relatively freely. For it, the Ministry of Environment issues a conclusion on whether the waste belongs to the Green list. When transporting such waste, the Annex VII form is filled in.

Yellow list: written consent

The Yellow list is hazardous waste. Its transportation requires written consent (notification) from the Ministry of Environment, as well as consent from the competent authorities of the import and transit states. The waste exporter must hold a license for operations with hazardous waste.

Procedure and terms

An official letter with completed notification forms is submitted at least 70 days before the planned date of the first transportation. Copies for the competent authorities of the import and transit states are filled in a language acceptable to them. The procedure is gradually moving to an electronic format.

What is prohibited

Importing hazardous waste into Ukraine for storage or burial is prohibited. Import of hazardous waste is possible only for recovery and with written consent. This must be taken into account already at the stage of planning the deal.

Classification of waste

Assigning waste to the Green or Yellow list depends on the composition and properties of the material. The UKT ZED code selection together with the waste description helps determine the category and code. An error in classification changes the whole permit route.

Transport of hazardous waste

Hazardous waste is often at the same time dangerous cargo and is transported under ADR rules. So requirements for the transport are added to the Ministry of Environment permit documents — these are handled by ADR dangerous goods transport.

Documents and customs

The conclusion or written consent goes to customs together with the invoice, foreign-trade contract, transport documents and notification forms. We work out the deal structure at foreign trade consulting, and clearance is handled by our customs broker.
