UKT ZED code selection for your goods

The UKT ZED code is the first thing that shapes an import: the duty rate, VAT, excise, the set of permits and the right to preferences all depend on it. An error in a single digit of the ten-digit code turns into additional charges, a fine and cargo held at the border. We select the code for the specific goods, substantiate it under the classification rules and, where it is justified, lock it in with an advance customs ruling. What the UKT ZED code is and why it governs the whole clearance

UKT ZED is the Ukrainian classification of goods for foreign economic activity, built on the international Harmonised System (HS) and the EU Combined Nomenclature. Each product is assigned a ten-digit code by which customs "understands" exactly what is crossing the border. Determining the code is the declarant's duty, and its correctness is checked by customs, including the automated clearance system. So code selection is not a formality but the point where the entire cost and legality of clearance is set.

Code structure: 10 digits

The code is read from the top down — from a broad group to a specific sub-category. The deeper the level, the more precise the description and the more correct the rate.

You must go down to the tenth digit: it is the full code that determines the duty and the list of requirements for the goods.

What the code affects

  • The import duty rate — ad valorem, specific or combined.
  • VAT and excise for excisable goods.
  • Permits: certificates, licences, sanitary, phytosanitary and veterinary control.
  • The right to preferences by country of origin — for example, a reduced or zero duty on imports from the EU with an EUR.1 certificate.

The 6 General Rules of Interpretation

Classification follows the six General Rules of Interpretation (GRI) — they are mandatory and applied in sequence, not at the declarant's choice.

  • Rule 1 — goods are classified by the headings and the notes to sections and groups. This is the basis of classification.
  • Rule 2 — incomplete and unassembled articles are treated as finished; a reference to a material also covers its mixtures and combinations.
  • Rule 3 — if several headings apply: 3a — the specific description prevails over the general; 3b — by the material or component giving the essential character; 3c — the last in ascending code order among equal ones.
  • Rule 4 — by analogy with the most similar goods, when rules 1–3 give no answer.
  • Rule 5 — cases, containers and packaging are classified together with the goods.
  • Rule 6 — choosing the subheading within an already determined four-digit heading.

Correctly applied GRI is the very justification of the code that withstands a customs check. The full text of the rules is set out in the Customs Code of Ukraine.

What is needed for accurate selection

The invoice description is almost never enough — customs cares about the substance of the goods. For a correct code we ask for:

  • An exact description and the purpose (function) of the goods.
  • The composition and material, and for mixtures — the shares of the components.
  • Technical parameters, model, standard.
  • If needed — technical documentation, photos, laboratory analysis results.

The more precise the inputs, the smaller the room for dispute with the inspector at clearance.

What an incorrect code leads to

An error in the code is not a "minor inaccuracy". Understating the rate turns into additional duty and VAT with a fine; overstating it means an overpayment that is hard to recover. Common consequences:

  • Additional charges and penalties.
  • Delay and extra inspection of the cargo.
  • Refusal to release until reclassification, and disputes with customs.
  • Accounting problems: the code is a mandatory field of the tax invoice.

A typical mistake is to pick a "shorter and cheaper" code without a GRI-based justification. At clearance such a code is almost always overturned against the importer.

Advance classification ruling

If the goods are new, complex or expensive, it is worth locking in the code in advance. An advance classification ruling is issued by the customs authority on application: the decision term is 30 days from registration, the ruling is valid for 3 years and is applied by all customs offices of Ukraine while the facts and conditions remain unchanged. This removes the risk of reclassification at the border and makes the payment calculation predictable. We prepare the application and support obtaining the ruling.

UKT ZED and DKPP — what not to confuse

UKT ZED is used at customs and determines the terms of import and export. DKPP is the state classifier of products and services for tax and statistical purposes, and its codes are different. Mixing these classifiers leads to errors in documents, so clearance always runs on UKT ZED.
