Customs agent and declarant: who they are and who is responsible for what
A customs agent and a declarant are different roles in customs clearance. A customs clearance agent is an employee of the broker, an individual who directly presents the goods and completes the declaration (the technical executor). A declarant is the person who bears legal responsibility for the information in the declaration and for compliance with the customs rules: the importer/exporter or the broker themselves. The difference is fixed in the Customs Code of Ukraine: Articles 265–266 govern the declarant, and Article 418 governs the customs clearance agent (Customs Code of Ukraine).
Confusing these concepts leads to a wrong understanding of who is responsible for errors in the declaration and for paying the charges. Below we examine each role separately, show how they are related to the customs broker, and who ultimately bears the responsibility.
Who the declarant is
The declarant is defined by Articles 265–266 of the Customs Code of Ukraine. Under Article 265 the declarant may be a resident who has concluded a foreign economic contract (an importer or exporter — the holder of the customs regime), or another person with the right to carry out legally significant actions with the goods. As a general rule, only residents of Ukraine may be declarants.
Article 266 sets out the duties, rights and responsibility of the declarant:
- Duties — to declare the goods, to present them for control on request, to submit documents and information, and to pay or secure the payment of the customs payments.
- Rights — before filing the declaration, to inspect the goods and take samples, and to demand the release of the cargo against security for the payment of charges.
- Responsibility — the declarant bears full responsibility for the violation of customs rules. An important nuance: a person authorised to declare on the declarant's behalf has the same duties, rights and responsibility as the declarant themselves.
Who the customs clearance agent is
The customs clearance agent is defined by Article 418 of the Customs Code of Ukraine. This is an individual — a resident — who is in an employment relationship with a customs broker and directly carries out the actions of presenting goods, means of transport and documents to the customs authority for control and clearance. The agent works at any customs authority of Ukraine.
Key features of the agent's status:
- This is an employee of the broker, not an independent participant in foreign economic activity.
- The legislation does not require the agent to pass a qualification exam and obtain a qualification certificate.
- The agent bears responsibility for the disclosure of commercial secrets and confidential information.
- It is the agent who physically completes the declaration — it is they, and not the declarant, who are indicated in box 54.
The agent, the declarant and the broker: how the roles are related
The three roles form a chain. The client (importer or exporter) concludes a contract with a customs broker — an enterprise with authorisation for broker activity. Within the broker, the customs clearance agent handles the actual clearance. But who acts as the declarant depends on the type of customs representation:
- Direct representation — the client remains the declarant, and the broker acts in their name.
- Indirect representation — the broker files the declaration in their own name and themselves becomes the declarant, bearing joint and several liability for the payment of the charges.
These schemes and their effect on liability are examined in detail in the material on the contract with a customs broker.
Comparison: the customs clearance agent and the declarant
| Feature | Customs clearance agent | Declarant |
|---|---|---|
| Who it is | An individual — an employee of the broker | The importer/exporter or the broker (with indirect representation) |
| Legal basis | Article 418 of the CCU | Articles 265–266 of the CCU |
| Role | Technical executor: presents the goods, completes the declaration | The bearer of legal responsibility for the declaration |
| Basis of work | Employment relationship with the broker | Foreign economic contract or powers |
| Responsibility | For the disclosure of commercial secrets | Full responsibility for the violation of customs rules and for the charges |
| Reflection in the declaration | Indicated in box 54 | Indicated as the declarant |
Who bears responsibility in practice
In practice the division is simple: the agent physically completes the declaration, but legal responsibility for the accuracy of the information and for compliance with the customs rules is borne by the declarant. If the importer acts as the declarant (direct representation), it is they who are responsible for violations; if the broker clears in their own name (indirect representation), responsibility for the charges becomes joint and several. That is why it is important for the importer to understand in what capacity they are acting and what is fixed in the contract with the broker. How to check the broker themselves is covered in the material on the register of customs brokers.
